Hayden Tan

PARTNER

Hayden Tan was called to the Bar of England & Wales and admitted as an Advocate & Solicitor of the High Court in Malaya in 2018. He is also a Singapore International Mediation Institute Accredited Mediator (Level 1). The current focus of his practice is corporate and commercial dispute resolution, as well as fraud defence. Before this, Hayden had a broad practice which included defamation, administrative and public law, employment, intellectual property, tax and commercial law. In 2023, Hayden was named by the Legal 500 as a rising star for Dispute Resolution (Malaysia). He was also featured in The Legal 500 Powerlist for Arbitration (Southeast Asia, 2022 & 2023). He had advised and acted in various high-profile commercial disputes including: •Defending a Johor based developer in the Kuala Lumpur commercial court against allegations of fraud made by the Inland Revenue Board. •Acting for the plaintiff in a fraudulent misrepresentation claim of more than RM 20 million. •Advising holders of notes issued and guaranteed by Indonesian companies regarding their rights against officers of the guarantor company and the arranging banks. •Advising a market maker in relation to allegations of market manipulation and false trading. •Acting for the corporate plaintiff against a successful regional budget airline regarding a licensing arrangement. •Advising partners to a duty free joint venture business regarding the business’s profit distribution mechanism. Acting for a share purchaser against MYSJ Sdn Bhd, the operator of the mobile application ‘MySejahtera’ used by the Government of Malaysia to combat Covid-19. •Acting as co-counsel for a Russian entity in a complex civil litigation, involving claims of defamation, breach of contract, copyright infringement and breach of confidential information. •Acting for a real estate investment trust in an assessment of damages proceeding relating to a multi-million ringgit claim based on conversion of hotel properties. •Acting for a former prime minister in a defamation claim. Hayden has authored/co-authored a number of publications such as “The Defence of ‘Good Faith’ in Malaysian Tax Cases” (Malayan Law Journal), “Employment Trends and Developments in Malaysia 2021” (Chambers & Partners), and “The Judicial Thoughts of Dato’ Seri Hishamudin Yunus” (Chapter 5). He was also recently invited by the Asian International Arbitration Centre (AIAC) as a panellist in the AIAC Young Practitioners’ Group Conference 2024 to discuss about arbitral measures.
